Terms and conditions for %%PLAN_NAME%%


In consideration for participating in the Painted Bar Stables %%PLAN_NAME%% Program, I hereby agree to the following.


A. Term of Membership.


This membership agreement is a month to month agreement and may be renewed on the 1st of every month. All memberships are prepaid in full with the first month being pro-rated for when membership was initiated. No reimbursements are possible for partial months used. Any violation of this membership or stables rules by the member will cause immediate termination.


B. Member Entitlements.


The Member acknowledges that this membership entitles them to the following:


1. Unlimited Access to Painted Bar Stables Facilities.


With this membership, members are entitled to unlimited access to Painted Bar Stables facilities and resources including: barn and stalls, indoor arena, outdoor arena, paddocks, PBS tack room, and trails used by Painted Bar Stables. It is understood that Painted Bar Stables always is entitled to primary use of all resources and that members cannot reserve resources already in use by Painted Bar Stables and their programs.


2. Designated number of practice rides per week (to be scheduled in advance).


The member is entitled to use an approved horse for their rides. It is understood the there is a hierarchy of use based on membership levels and that Painted Bar Stables always is entitled to specific use of a horse. Members must ask Painted Bar Stables ahead of time and consult the online calendar to determine when horses are available for use. Rides without a Painted Bar Stables guide must be pre-approved. I understand that these practice rides DO NOT accumulate, and will be forfeited if I do not show up to ride. The duration of the practice rides will not exceed two (2) hours with the horse and that the horse must be returned on time. I agree to thoroughly cool out the horse after each ride for a minimum of 10 minutes and put him away clean, dry and appropriately blanketed.


3. One Lesson per month: Painted Bar Stables requires members to participate in one group or private lesson in order for staff to continually reevaluate status, troubleshoot problems and touch base as well as for members to improve skills and to be introduced to new or more difficult horses.


4. Use of tack and equipment, i.e., saddle, saddle pad, bridle, protective horse boots, blankets, horse brushes, halter and lead rope. This equipment is provided by the Painted Bar Stables and is in excellent condition and repair. I agree to only use the tack and equipment assigned and approved for the horse I am riding. I agree to clean and wipe down the saddle, bit and bridle used by me each time I finish riding, and return the equipment to its proper place and in general, clean up after each ride (i.e., leave the stable as I found it or better). This includes discarding any horse manure that the horse may leave in the main aisles or elsewhere in the facilities.


C. Protective headgear will be worn while riding.


I agree to provide my own protective headgear, an SEI approved riding helmet, and I agree to wear this helmet each time I ride. Any member riding without protective headgear or without signing the waiver below instantly terminates this membership, and any membership exchange will be forfeited.


D. Appropriate riding apparel will be worn.


I understand that sneakers, sandals, and restricting clothing are not appropriate riding apparel and I will not wear them while around the Painted Bar Stables facilities or near any of the horses. I will wear appropriate footwear, i.e., either paddock boots, tall boots or regular shoes with a low heel.


E. Approved Horses and Rider Disclosure


It is understood that I may only ride horses that I am approved to ride based on my height, weight, riding skills and personality. I understand that certain horses can only carry riders of a certain weight. I also understand that some horses may have personalities and/or training that the stables feel conflict with my own personality or riding technique and I may be restricted from riding these horses without explanation.


It is understood that I may be expected to ride horses other than the horse of my choice if said horses are not available. The membership program does not guarantee a specific horse of choice but merely the ability to ride independently on a horse owned or under contract by the stables.


F. Sole Riding Privileges.


I understand that I have sole riding privilege and will not allow anyone else (family, relative or friend) on the horse during the membership period. All guests to the stables facility will be required to sign the stable waiver. Membership will be terminated and membership fee forfeited if I allow anyone else on a horse during the membership period.


G. Sole Owner of the Horse.


The Painted Bar Stables is the sole owner of the horses used and has complete authority regarding care and use of this horse by the Member. The Painted Bar Stables warrants that the Painted Bar Stables and its owners have on premises a good and clear title to the Horses, free from any liens. During the course of this membership, the horses will remain free of all liens, charges and claims and the horse will not be sold or mortgaged. The horses are and shall remain the sole property of the Painted Bar Stables. Painted Bar Stables has sole ownership and responsibility of the other horses at the stable and has the sole power of authority over said horses.


H. Emergency Care.


In the case of the need for emergency and/or major veterinary care: if the horses experiences an injury or medical issue as a result of the Painted Bar Stables’ care, Painted Bar Stables will take on the entirety of the expenses for the needed emergency veterinary care.


If the injury or medical issue as a result of the Member’s actions or while under the supervision of the Member (i.e., severe cuts during trail rides, lameness after a strenuous work out, metabolic issues related to riding such as dehydration or tying up, etc...), the Member agrees to split the cost of the needed emergency veterinary care with the Painted Bar Stables, each paying equal halves (including taxes, surcharges and additional fees).


I. Right to Inspection.


The Painted Bar Stables has the right at any time, in person or by authorized agent, to inspect the horses to determine if the horses are being properly cared for, treated with respect, and are in good health. The Painted Bar Stables reserves the right to terminate this agreement immediately if the horses are not being properly cared for by the Member.


J. Payment.


The Member agrees that in payment for the rights to said horses, the Member will pay the following rates.


1. Fees.

  per month paid by the Member in advance on the first day of each month.

2. Payable To: Payment is accepted in the form of cash or check and placed in a labeled envelope in the drop box in the barn. All payments must be made payable to Painted Bar Stables.

3. Painted Bar Stables Responsibility. It is understood that the Painted Bar Stables is in no way responsible for transportation, scheduling conflicts, meals, proper attire or personal safety equipment (helmet included).


The Painted Bar Stables is responsible for educating, instructing, and informing the Member on all aspects of their role and the jobs that they are expected to complete. It is understood that if the Member ever feels under- or mis-informed, and that this lack of information may cause personal harm, they may refuse to carry out a task.


K. Self-Preparation Programs:

Riders are responsible for their own preparation and mounting and must be able to ready their own horse sufficiently without an instructor checking girths or adjusting stirrup lengths. They must be able to mount with the only assistance provided by the instructor being to perhaps hold their horse at the horse's head but with no interaction at the saddle.


L. Cleanup Procedure:

After the ride students will be expected to both untack their horse. Before putting their tack away, members must clean and re-condition their tack with provided supplies.Members must make sure that all tack has been wiped down and is clean of dust and/or mud. Tack must be stored properly. Repeated mistakes in storing tack inappropriately may result in the loss of your membership.


Members will be expected to do all of the preparation, readying, recreation, horse care on their own as well as their own cleaning when finished. Staff may then do a once-over sanitation after they are gone as well.


Everyone attending any program at the barn should budget an additional 30 minutes both before and after into their visit for preparation and grooming of the horse and cleaning and properly storing equipment in order to avoid rushing and to be thorough.


M. Hold Harmless.


Member hereby agrees to hold the Painted Bar Stables and Painted Bar Stables, and all affiliated with the stable, harmless from and against any and all claims, actions, damages, liability and expense in connection with the loss of life, third party claims, personal injury and or/damage to property arising out of Member’s care and/or use of the horse.


IN SIGNING THIS MEMBERSHIP, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing, understand it and sign it voluntarily as my own free act and deed, no oral representations, statement or inducements, apart from the foregoing written agreement have been made; I am at membership eighteen (18) years of age (If minor, parent or person representing himself/herself to be the lawful Guardian must sign), and I am fully competent. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of New York.
